Why legal due diligence or Title search  

Title Search before purchase of any immoveable assets, reveals the true ownership and defects in the title of property and eliminates the possibility of any potentional threat of litigation after possession. It is the settled law of let the buyer beware, which means the purchaser has to confirm for himself the defects in the property before purchase, because purchaser acquires from the seller the same title the seller is holding. This is to avoid any defect in title and possession hence, prior title search is of great importance to ensure smooth transition of property from one hand to another.

Zonal due diligence is conducted to verify the viability of the property to be used for any commercial activity like warehouse, Big Retail shops.

  1. Ownership detail
  2. Address
  3. Survey number, Khasra/Khatoni/Khewat details
  4. Area/size of the land
  5. Boundaries and location
  6. Freehold / Leasehold / Perpetual lease / Government grant
  7. Status of possession
  8. Whether the title is marketable and clear
  9. Details of any mortgages, charges, liens, or loans on the property
  10. Any pending bank dues, litigation, or notices
